GENERAL TERMS AND CONDITIONS

Reservation deadlines

Requests for booking are accepted within 3 days prior to arrival from Monday to Friday (except national holidays).
Special and urgent reservations can be accepted but are subject to special payment conditions and availability of the required services (see specific paragraph).

Booking procedure

All bookings must be made in written form (by e-mail to info@smarttravel.ee) or through website reservations form or by calling to +372 614 3490.
Smart Travel OÜ will revert with the booking confirmation and booking details as soon as possible, and in any case within 48 hours (weekends and holidays excluded)
If any of the required services (travel services or packages) are unavailable at the time of booking, Smart Travel OÜ will put all efforts to offer an alternative solution, nevertheless Smart Travel OÜ retains the right to change the conditions of use of its existing travel services unilaterally and at any time.
In case of travel service or package for groups, we must receive, at least 25 days prior to arrival, a detailed rooming list including exact arrival and departure time.

Cancellation and changes procedure

All updates/changes of bookings and cancellations must be made in written form (by e-mail to info@smarttravel.ee).
Cancellation and/or update must be confirmed back to you by Smart Travel OÜ. If you have not received a confirmation of the cancellation an/or update within 24 hours after notification, it means that Smart Travel OÜ has not received it and you must inform Smart Travel OÜ once again.
In case of update and/or cancellation of confirmed booking, Smart Travel OÜ reserves the right to charge a fee for services and expenses in case those costs are charged by the tourist operator to Smart Travel OÜ (normally the fees are calculated in percentage of the booking value). Exact cancellation terms are specified in the confirmation.
Booking changes and/or cancellations notified directly to any of the tourist operator (Hotel, restaurant etc) will not be effective.

Cancellation conditions for single travel service for individual tourists

Cancellation notified up to 72 hours prior to arrival is free of charge and customer is entitled to the full reimbursement except the case where a deposit has been required. Deposit is required as a guarantee and is not reimbursed. Please also refer to specific packages offers conditions.
In case of cancellation notified less than 72 hours prior to arrival and/or in case of “no-show”, the customer is not entitled to any refund.
The effective date from which the days to arrival will be counted is the day when Smart Travel OÜ has been notified of the cancellation in written form.
The effective dates, based on working days, are calculated from Monday to Friday, from 09.00 to 17.00 Estonian time GMT+2 (except public holidays).

Cancellation conditions for travel package for individual tourists

Cancellation notified up to 15 days prior to arrival is free of charge and customer is entitled to the full reimbursement except the case where a deposit has been required. Deposit is required as a guarantee and is not reimbursed. For guaranteed tours please refer to the corresponding terms and conditions indicated in the web page.
In case of cancellation notified less than 15 days prior to arrival and/or in case of “no-show”, the customer is entitled to 50% reimbursement of the total package price.
In case of cancellation notified less than 7 days prior to arrival and/or in case of “no-show”, the customer is not entitled to any refund.
The effective date from which the days to arrival will be counted is the day when Smart Travel OÜ has been notified of the cancellation in written form.
The effective dates, based on working days, are calculated from Monday to Friday, from 09.00 to 17.00 Estonian time GMT+2 (except public holidays).
Cancellation conditions for groups
Cancellation notified up to 45 days prior to arrival is free of charge and customer is entitled to the full reimbursement except the case where a down-payment has been required. Down-payment is required as a guarantee and is never reimbursed.

Cancellation notified less than 45 days is subject to the following cancellation fee
-from 44 to 35 days : cancellation fee 40% of total booking value
-from 34 to 25 days : cancellation fee 70% of total booking value
-from 24 to 15 days : cancellation fee 90% of total booking value
-Less than 14 days and “no-show” : cancellation fee 100% of total booking value

The effective date from which the days to arrival will be counted is the day when Smart Travel OÜ has been notified of the cancellation in written form.
The effective dates, based on working days, are calculated from Monday to Friday, from 09.00 to 17.00 Estonian time GMT+2 (except public holidays).
Changes of dates and reduction of the size of the group are considered as being cancellations, unless otherwise agreed in written form.

Payment policy

1) Individuals for travel service
Unless otherwise agreed, the full payment for the requested travel service is required 15 days prior to arrival.

2) Individuals for package
Unless otherwise agreed, a down-payment of 20% of the total package value is required at the time of the reservation/booking and the balance payment for the requested package is required 40 days prior to arrival.

3) Groups for travel service and/or package
Unless otherwise agreed, a down-payment of 30% of the total package value is required at the time of the reservation/booking and the full payment of the remaining 70% is required 45 days prior to arrival.

Request for booking notified less than 3 days prior to arrival can be accepted only upon payment settlement within 24 hours after receiving confirmation.

Payment can be done by bank transfer (according to the bank account details indicated in the invoice) not later than the invoice due date or by credit card.
All bank charges (domestic and foreign) are to be borned by the customer (valid in case of refund as well).
Smart Travel OÜ reserves the right to cancel the reservation in the event of non-payment.

Once the payment is received, Smart Travel OÜ will forward to the customer an accommodation voucher (by email or fax or mail) which must be supplied to the hotel reception by the arrival.
The customer is responsible for all extra services provided by the hotel (minibar, phone, Pay-TV, laundry etc). The customer must pay these costs directly to the hotel by the check-out.

Prices

All prices are net and include all taxes, visa (if needed). Insurances, flights and any other expenses not specified in the offer as to be paid by the customers. Prices can be subject to variation without prior notice when events/reasons occur beyond Smart Travel’s control.

Currency

Official prices are given in Euro. Any other currency used on our website is given just as an indication. Currency exchange rates on our website may not be up-to-date.

Rating of accommodation facilities

The rating (stars or „class” levels) are defined by local and official competent authorities.
Smart Travel OÜ reminds the customer that the criteria of rating assessment might vary from country to country, therefore Smart Travel OÜ bears no responsibility linked to customer’s quality complaints.

Force Majeure

Smart Travel OÜ bears no responsibility and liability in case of loss, strikes, accident, delay, sickness, acts of God, riot, war, fire, floods or other force majeure or other factors beyond Smart Travel’s control.

Hotel overbooking

In the very unlikely case that the hotel cannot provide the booked accommodation, the hotel’s responsibility is to find an alternative or at least a similar solution and provide transportation free of charge for the customer to the alternative hotel. Smart Travel OÜ shall have no liability in respect of any other costs, losses or damages arising out of or in connection with relocation of accommodation since such relocation is beyond the control of Smart Travel OÜ.

Travel documents

Passport or ID card (depending on traveller’s country of origin), visa (if needed). Health and travel insurance (including cancellation insurance) are at customer’s responsibility and costs.

Responsibility

The customer confirms that he or she is at least 18 years old, has the legal authority to enter this agreement and all the information supplied are accurate and true.
By making a booking to Smart Travel OÜ the customer understands and accepts all terms and conditions stated above.

Quality guaranty

All information published on the website is current and is subject to change without prior notice. Smart Travel OÜ cannot accept responsibility for accommodation facilities, which are temporarily not available, are under renovation or do not suit customer’s preferences, as well as for any disturbance or inconvenience to the customer beyond their control nor for accidents or losses caused by accommodation facility management or staff. The effects of normal wear and tear can be expected in a hotel and these are beyond Smart Travel OÜ’s control.

Update

Smart Travel OÜ retains the right to change, update or delete any information on its website without prior notice.
